If there was any indication of chemical use, I always recommend that my client set up an appointment for a chemical use assessment. If a plea agreement is reached or if the charges are going to be dismissed one of the things that the prosecutor wants to know is that they do not have to worry about there being future problems.
The same logic goes along with setting up an appointment for an anger management assessment. Typically, if you take control of your case and be proactive you can achieve a better result much faster.
DANCOs, or domestic abuse no contact orders, are court orders that are filed in some domestic assault cases. If one is put in place the defendant cannot have contact with the alleged victim. Defendant’s often fall into the trap of the alleged victim placing telephone calls or make contact. A DANCO is a one way street. If the Defendant has any contact, this will result in an additional charge of a violation of a DANCO.
It is not uncommon for charges to be filed and then have the alleged victim have a change of heart or the true story come out later. After a report is made, it is out of the hands of the alleged victim to dismiss the charges; however, that does not mean they do not have a hand in what takes place. They can contact the prosecutor and request the charges be dismissed. Additionally, I also draft an affidavit of the alleged victim that outlines their version of the events that took place.
Hire a lawyer quickly. If you take any of my advice, this is the one. The legal system is adversarial. Charges just do not get dismissed and cases do not go away. The State has endless resources at their disposal. You need someone that will stand up for your rights.
